What happened
In July 2026, IRAS revised its guidance on withholding tax for technical and management services paid to non-resident persons under section 45A of the Income Tax Act 1947:
- Services performed in Singapore vs overseas: payments for management and technical assistance fees are subject to withholding tax only to the extent that the services are physically performed in Singapore.
- Allocation methodologies: where services are performed partly in Singapore and partly overseas, taxpayers must maintain detailed time sheets, flight itineraries and activity logs to support the allocation between Singapore-source (taxable) and foreign-source (exempt) portions.
- Reimbursements vs disbursements: IRAS clarified that pure cost disbursements incurred on behalf of the Singapore payer are not subject to withholding tax, but administrative mark-ups or lump-sum recharges are treated as service fees subject to withholding.
- Filing deadline: withholding tax must be electronically filed and paid by the 15th of the second month following the date of payment or crediting.
Why it matters
Cross-border service fees between group entities are an everyday operational reality for multinational groups headquartered or operating in Singapore.
IRAS audits routinely challenge unsupported allocations where management fees are claimed to be 100% offshore. If a non-resident service provider visits Singapore even for a few days of client presentations or strategy workshops, the fee must be apportioned. Penalties for late withholding tax reach up to 20%, plus interest.
What to do now
- Review all cross-border intercompany service agreements to distinguish between management services, technical fees, royalties, and routine shared-service recharges.
- Implement travel and time-tracking protocols for overseas executives visiting Singapore to perform services.
- Automate withholding tax reminders to ensure filings are made before the strict statutory deadline (15th of the second month following payment/crediting).
